“British Drivers Could Claim £830 – HD Law Raises Concerns”

Millions of British citizens may be entitled to a higher payment of £830 following a significant development in the car finance mis-selling scandal. Despite this increased amount, legal entity HD Law has raised concerns about whether affected drivers are receiving their full entitlement, as compensation payouts for victims of the scandal draw nearer.

Based on HD Law’s historical data, individuals could potentially receive more than double the £830 sum proposed by the Financial Conduct Authority (FCA). The announcement late yesterday revealed that compensation is anticipated to be disbursed for over 12 million car finance contracts mis-sold between 2007 and 2024.

Although the FCA indicated a lower number of affected individuals than initially estimated, the average payout per agreement has risen to approximately £830. The FCA predicts that 75% of eligible consumers will file claims, potentially resulting in a total redress payout of £7.5 billion.

Previously, the FCA stated that the average compensation for participants in the scheme would be around £700, with a total cost that could exceed £8 billion. However, the new £830 figure does not reflect the potential individual claims that could be pursued through legal channels.

Kevin Durkin, Director of HD Law, expressed skepticism regarding the FCA’s redress scheme, emphasizing the need for fair compensation for consumers based on legal rulings. Lenders are required to notify complainants within three months from the end of the implementation period regarding the compensation owed, expediting the process for prompt reimbursements.

To qualify for compensation, the agreement must have been a Personal Contract Purchase or Hire Purchase for personal use, excluding leased vehicles. Those eligible for redress were impacted by discretionary commission arrangements between dealers and lenders, which resulted in higher interest rates for customers. Such practices were prohibited by the FCA in 2021 to safeguard consumer interests.
