Dorothy Cook dedicated herself to caring for her husband, Melvin, for nearly five decades after he was diagnosed with a rare brain condition. However, her efforts hit a roadblock when a doctor refused to release him from the hospital due to the absence of a power of attorney.
Power of attorney is a legal tool that authorizes a trusted individual to make decisions regarding finances, property, or healthcare on someone else’s behalf. Dorothy, a former occupational psychologist from Bristol, had left her career to provide full-time care to Melvin, who suffered from ataxia, a progressive neurological disorder affecting his mobility and communication.
During a hospital stay in March 2025, a doctor determined that Melvin lacked mental capacity, preventing his discharge. Dorothy clarified that his communication challenges, not a lack of capacity, caused the misunderstanding. Despite not being present during the assessment, Dorothy demonstrated her capability to care for Melvin, ultimately securing his release.
Had she failed to prove her competence, the hospital team could have legally intervened. Melvin, once a successful engineer involved in designing Concorde’s nose, began showing ataxia symptoms 17 years prior, prompting Dorothy to become his full-time caregiver as his health declined.
Tragically, Melvin passed away at 78 in June 2025, but Dorothy is using her experience to advocate for power of attorney awareness on the inaugural nationwide Power of Attorney Day. She emphasized the importance of setting up power of attorney promptly to avoid the challenges she faced.
Carers UK and Standard Life collaborated to launch the UK-wide Power of Attorney Day, highlighting that only 8% of adults have updated power of attorney documents. Despite its significance, less than half of individuals prioritize establishing power of attorney, especially as they age.
Helen Walker, Carers UK’s Chief Executive, urged individuals to address power of attorney proactively to honor their preferences and alleviate future stress. Claire Hawkins, Director of Corporate Affairs and Brand at Standard Life, emphasized the critical role of power of attorney in safeguarding finances during unexpected life events.
